New York construction accident lawyer David Perecman comments on a recent New York construction accident in which two iron workers died. Brett McEnroe, 49, and Roy Powell, 51,died after a five-story fall on a New York church construction site. The two construction workers fell down an elevator shaft. Notably, they lacked even the most basic fall protection.

Investigators who visited the site believe the two men fell while they were installing steel beams in the elevator shaft. Apparently, one of the beams shifted or gave way. A New York City Buildings Department representative said that the workers most likely did not have adequate fall protection. Fall protection for construction workers can include harnesses, safety netting or a support platform.

New York construction accident lawyer David Perecman, a New York construction accident lawyer for more than 30 years, wants to remind construction workers and construction companies that safety precautions on construction sites is the law.

This fatal construction accident brings the number of New York construction deaths in 2011 to 3. In 2010, there only 4construction-related deaths. There were 3 New York construction deaths in 2009.

A series of violations are tied to this church building site. These violations stretch back to 2009, over a year before the deaths of the two construction workers.

The New York Department of Buildings and the Occupational Safety and Health Administration (OSHA) are looking into the tragic construction accident. New York construction accident lawyer Perecman is following the story.
